IMMIGRATION LAW IN ETHIOPIA: YOUR RIGHTS AND REQUIREMENTS

Enshrined in Proclamation 334/2003 and Regulation 114/2004, these laws set out the rules and regulations for entry into, departure from, and residence in Ethiopia for foreigners. Entry into Ethiopia:

Before entering Ethiopia, a foreigner must ensure they possess the following:

  1. A valid travel document,
  2. A valid entry visa or a valid permanent residence permit
  3. A health certificate, as required,
  4. For those holding transit or tourist visas, in addition to the above, they must also possess:
  5. A ticket valid for travel from Ethiopia to another country,
  6. Unless deemed unnecessary, a valid visa and health certificate enabling entry into the country of destination.

Minors can enter Ethiopia if registered in the travel document of the accompanying person. If traveling alone, there should be a designated person responsible for them in Ethiopia.

Departure from Ethiopia

Unless prohibited by a court order in accordance with the law, anyone can depart from Ethiopia. The same entry requirements apply to a person departing from Ethiopia.

  • Has been declared a drug addict,
  • Is suspected of having a dangerous contagious disease,
  • Is a threat to the security of Ethiopia,
  • Has provided fraudulent information,
  • Has violated any provisions stipulated by the ministry.

Registration of Foreigners and Residence Permit

Registration is mandatory for any foreigner:

  • Residing in Ethiopia
  • Entering Ethiopia with an immigrant visa within thirty days of arrival
  • Entering Ethiopia with a business or student visa and intends to stay for more than ninety days, within thirty days of arrival,
  • Allowed to stay without a visa and intends to stay for more than ninety days, within thirty days of arrival.

Certain individuals, such as diplomats, international civil servants, recognized refugees, and others exempted by law or treaties, are not required to register but must obtain an identity card within thirty days of arrival.

Permanent Residence Permit

A permanent residence permit is granted to a foreigner who meets specific conditions, including having been in Ethiopia for at least three years preceding the application, having a lawful source of income, and being of good character.

Temporary Residence Permit

A temporary residence permit is issued to foreigners who are not entitled to a permanent residence permit. This permit is valid for up to one year and may be renewed if necessary.

Revocation of Residence Permit

A residence permit may be revoked if obtained with false evidence, if the holder stays abroad for more than one year without permission, or if the permit was obtained based on a marriage of convenience.

Port Of Entry, Exit, and Immigration Control

Immigration officers are responsible for controlling entries and exits from Ethiopia. Ports of entry and exit include Addis Ababa and Dire Dawa by air and several land ports.

Deportation of Foreigners from Ethiopia

If a foreigner’s visa is cancelled, a deportation order may be issued, specifying the reason for deportation, the date of departure, and the port of exit. The foreigner may be deported to their country of origin or another willing country, with the traveler covering their travel expenses.
